Specifically, this Article discusses (1) a summary of the legal and scientific standards affecting rangeland and riparian resources; (2) ESA standards and procedures; (3) ESA litigation; (4) on-the-ground examples of ESA species and habitat protection; (5) application of the Administrative Procedures Act (APA) to ESA riparian-grazing cases, including final actions, parties, standing, and ripeness; and (6) the future of the ESA and current legislative efforts to gut the Act. The Article concludes by assessing how attacks on the Act may actually lead to reforms of livestock grazing on federal lands.Item Open Access Journal of Environmental Law & Litigation : Vol. 20, No. 1, p. 071-083 : Changes in Oregon's Water Quality Standards for Toxics(University of Oregon School of Law, 2005) Fitzpatrick, Martin S.Item Open Access Journal of Environmental Law & Litigation : Vol. 20, No. 1, p. 085-109 : Environmental Injustice Posed by Oregon's Water Quality Standards(University of Oregon School of Law, 2005) Bell, NinaItem Open Access Journal of Environmental Law & Litigation : Vol. 19, No. 2, p. 461-467 : Current Status of Access and Availability of Plant Genetic Resources(University of Oregon School of Law, 2004) Shands, Henry L.Item Open Access Journal of Environmental Law & Litigation : Vol. 19, No. 2, p. 472-478 : Farmers' Rights(University of Oregon School of Law, 2004) Haapala, John E., Jr.Item Open Access Journal of Environmental Law & Litigation : Vol. 19, No. 2, p. 500-538 : Originalism, J.E.M., and the Food Supply, or Will the Real Decision Maker Please Stand Up?(University of Oregon School of Law, 2004) Pollack, MallaItem Open Access Journal of Environmental Law & Litigation : Vol. 19, No. 2, p. 397-454 : Malthus, Mendel, and Monsanto: Intellectual Property and the Law and Politics of Global Food Supply: An Introduction(University of Oregon School of Law, 2004) Aoki, Keith, 1955-Item Open Access Journal of Environmental Law & Litigation : Vol. 19, No. 2, p. 469-471: Progress Without Patents: Public Maintenance of Agricultural Knowledge(University of Oregon School of Law, 2004) Jones, Stephen S.Item Open Access Oregon Law Review : Vol. 81, No. 1, p. 161-182 : Innocence Abroad: The Extradition Cases and the Future of Capital Litigation(University of Oregon School of Law, 2002) Givelber, DanielPresented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?Item Open Access Oregon Law Review : Vol. 81, no. 1, p. 097-130 : Capital Punishment and American Exceptionalism(University of Oregon School of Law, 2002) Steiker, Carol S.Presented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?Item Open Access Oregon Law Review : Vol. 81, no. 1, p. 001-014 : Forward: The Future of Capital Punishment in the United States(2002) Aldave, Barbara BaderForward to an Oregon Law Review issue containing papers presented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?Item Open Access Oregon Law Review : Vol. 81, no. 1, p. 131-160 : The Death Penalty in the United States: Following the European Lead?(University of Oregon School of Law, 2002) Demleitner, Nora V.Presented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?Item Open Access Oregon Law Review : Vol. 81, no. 1, p. 039-096 : Race, Region, and Death Sentencing in Illinois, 1988-1997(University of Oregon School of Law, 2002) Pierce, Glenn L.; Radelet, Michael L.Presented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?Item Open Access Oregon Law Review : Vol. 81, no. 1, p. 015-038 : Black Man’s Burden: Race and the Death Penalty in America(University of Oregon School of Law, 2002) Ogletree, Charles J.Presented at the Wayne Morse Center for Law and Politics Symposium: The Law and Politics of the Death Penalty: Abolition, Moratorium, or Reform?
