If you wish to appeal, you must file a notice of intent to appeal with the Land Use Board of Appeals (LUBA) no later than 21 days from the date the decision was mailed to you by the local government. J:\pa\paa\forms\noticead.frm revised: 7/29/99 0 - 0 2 - 0 7 BEFORE THE BOARD OF COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF JEFFERSON IN THE MATTER OF THE REPEAL OF THE APRIL, 2003 JEFFERSON COUNTY ZONING ORDINANCE AND THE 2000 JEFFERSON COUNTY SUBDIVISION ORDINANCE, AND THE ADOPTION OF A NEW ZONING ORDINANCE Ordinance No. Q-02-07 WHEREAS, Jefferson County wishes to amend its land use and subdivision regulations to correct inconsistencies, to clarify terms and standards, to make the documents more user friendly for County citizens, to comply with state statutes and administrative rules, and to add certain uses allowed by state statute but not allowed in the County under the current regulations; and WHEREAS, in late 2004 the Jefferson County Planning Commission began reviewing the Jefferson County Zoning Ordinance and Jefferson County Subdivision Ordinance for potential amendments, and was instrumental in developing a draft of a revised Zoning Ordinance which incorporated land division regulations; and WHEREAS, in accordance with ORS 197.610, notice of the proposed revision, along with two copies of the draft Zoning Ordinance, was mailed to the Department of Land Conservation and Development on April 17,2006, and was sent electronically on the same date; and WHEREAS, on May 9, 2006 individual written notice, including a schedule of public hearings, was mailed to all property owners in the unincorporated areas of the County outside the boundaries of the Confederated Tribes of the Warm Springs Indian Reservation, in accordance with ORS 215.503; and WHEREAS, the Jefferson County Planning Commission held public hearings on the proposed Zoning Ordinance revision on June 17, June 29, July 6 and July 22, 2006, and met to deliberate and consider the testimony on August 3, August 17 and August 23, 2006, after which they voted unanimously to recommend that the Board of Commissioners repeal the 2003 Jefferson Zoning Ordinance and 2000 Jefferson County Subdivision Ordinance, and adopt a new Zoning Ordinance; and WHEREAS, the Jefferson County Board of Commissioners accepted testimony on the Zoning Ordinance revisions recommended by the Planning Commission at public hearings on September 6, September 13, September 27, October 4, October 11, November 8 and December 20, 2006; reviewed all written testimony submitted from May 9, 2006 until the close of the hearing on December 20, 2006; and met in work sessions to deliberate on the proposed revisions on October 25, November 29, December 6, December 13, and December 21,2006; and ORDINANCE - Zoning Ordinance revision 1 0 - 0 2 - 0 7 WHEREAS, notice of all public hearings and work sessions before the Planning Commission and Board of Commissioners was published in the Madras Pioneer at least ten days prior to each hearing and work session, in accordance with ORS 215.060. NOW THEREFORE, the Jefferson County Board of Commissioners hereby ORDAINS as follows: 1. Adoption of Findings The Findings of Fact and Conclusions in the attached Exhibit A are hereby adopted and incorporated herein by reference as the basis for the decision to adopt the revised Zoning Ordinance. 2. Repeal of April, 2003 Zoning Ordinance The April, 2003 Jefferson County Zoning Ordinance, as amended, is hereby repealed. 3. Repeal of Ordinance O-160-00 The Jefferson County Subdivision Ordinance, adopted in December, 2000 by Ordinance #0-160-00, is hereby repealed. 4. Adoption of New Zoning Ordinance The 2007 Jefferson County Zoning Ordinance is hereby adopted as shown in Exhibit B, attached hereto and incorporated herein by this reference. 5. Severability The provisions of this ordinance are severable. If any section, subsection, sentence, clause or phrase of this ordinance or exhibit thereto is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance or exhibits thereto. 6.
