The City of JohnDay amended their Development Code November 2010; the city finds it necessary to do some housekeeping items addressing the number of animals that can be allowed within the city limits; provide standards and procedures for rebuilding single family dwellings in the Downtown/General Commercial Districts; waive the notification and meeting procedures in certain cases for Neighborhood Meetings requirements. Attached is adopted Ordinance No. 12-151-01.

Ordinance No. 10-145-05 amended the zone classification of the area annexed into the City of John Day by Ordinance No. 10-144-04 from county-zone classifications "GI" General Industrial and "SRI" Suburban Residential 1 to the city-zone classification "AIP" Airport Industrial Park and "RG" Residential General. The City of John Day is in the process of updating the zoning map and will send to DLCD as soon as it is available.

DLCD awarded the City of John Day a planning grant for an update to the City's Development code. The grant also supports revisions to the City of John Day-Grant County Urban Growth Management Agreement (UGMA). The purpose of the updates is as follows: 1) Achieve consistency with changes in State law and administrative rules approved since 2005. 2) Resolve the City's identified permit problems/desires based on past years of development permit processing. 3) Codify results of past years of planning grant projects. 4) Achieve increased efficiency in permitting within the bounds of State law.

The purpose of the enclosed Development Code and Zoning Map amendments is twofold. First, the amendments update the city's land use regulation to comply with the State Airport Planning Rule and Transportation Planning Rule (TPR). The Airport Planning Rule requires that cities adopt land use regulations to protect public safety and maintain land use compatibility in the vicinity of airports; and the TPR requires that cities plan for multiple mode of transportation, including airport facilities where applicable. Second, the proposed amendments streamline the land use permitting process for projects that are located within the John Day Industrial Business Park, consistent with state Industrial Lands Certification requirements. The proposed Airport Industrial Park (AIP) zoning, which will be applied to the business park upon annexation, allows a wider range of employment uses than is allowed under Ci ty's industrial zoning, and it removes the conditional use permit requirement for uses that are considered compatible with airport operations and safety. New residential uses are not allowed within the AIP zone.
