DLCD was notified of adoption of Qrd 914 on this matter in October 2009. Following enactment. Notice of Intent to Appeal was filed with LUBA. The City and Petitioner came to an agreement on the language in the enacting ordinance and the Citv voluntarily remanded the ordinance. LUBA approved that remand on November 13. On November 16. the City Council Enacted Qrd 915. a restatement of Qrd 914. removing the offending recital from the ordinance.
